1. About these terms
These terms are an agreement between you and Mmogo Media (Pty) Ltd, a company registered in South Africa ("we", "us"), for your use of the Kululu app and the kululu.kids website. By creating an account or using Kululu, you agree to these terms and to our privacy policy, which explains how we handle your family's information.
Nothing in these terms takes away rights you have under consumer protection law, including South Africa's Consumer Protection Act. Where the law gives you more protection than these terms, the law applies.
2. Accounts
- You must be 18 or older, and a parent or legal guardian of the children you add, to create a Kululu account.
- Give us accurate information and keep your password safe. You're responsible for activity on your account.
- One account can hold up to 6 children in the same family.
- You can delete your account at any time in the Parent Area. See our privacy policy for what that deletes.
3. Children's use
Kululu is made for children from about age 1 to 5, used with a parent's permission. You decide how and when your children use it. We design Kululu to be safe, with no ads, a grown-up check on settings and purchases, and no chat, but no app replaces a grown-up nearby. We recommend following your child's healthcare provider's guidance on screen time.
Kululu's activities are educational play, not a formal curriculum or assessment. We don't promise any particular learning outcome.
4. Kululu Premium
Colours, Numbers and Kululu's first story are free. Kululu Premium is an auto-renewing subscription that unlocks every activity, story and adventure, and Premium features such as the name voice, for every child on your account.
- Plans. Premium is available weekly, monthly or yearly. In South Africa the prices are R29.99 a week, R89.99 a month or R899.99 a year. In other countries the App Store shows the local price before you buy.
- Introductory offer. New subscribers to the monthly plan may pay a lower price for their first month (R49.99 in South Africa). Each Apple Account can use an introductory offer once. After the offer, the regular price applies unless you cancel.
- Payment. Payment is taken by Apple from your Apple Account when you confirm the purchase. We never see your payment details.
- Automatic renewal. Your subscription renews automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your Apple Account is charged within 24 hours before the renewal.
- Price changes. If we raise the price of your plan, Apple will tell you in advance and, where required, ask for your agreement before charging the new price.
- Family Sharing. A subscription covers every child on your Kululu account. It isn't shared with other Apple Accounts through Family Sharing unless we tell you otherwise in the App Store.
- Promotions. From time to time we may unlock Premium for everyone for a limited period, or give Premium to some families at no charge. These end at the stated time and don't create an ongoing right to Premium.
5. Cancelling and refunds
You can cancel at any time in Settings › your name › Subscriptions on your iPhone or iPad. When you cancel, you keep Premium until the end of the period you've already paid for, and you won't be charged again. Deleting the app or your Kululu account does not cancel your subscription.
Because Apple takes the payment, refunds are requested from and decided by Apple at reportaproblem.apple.com, under Apple's policies. This doesn't affect any right to a refund you have under consumer protection law, and if you think Kululu hasn't worked as it should, please tell us and we'll help.
6. Family circles and cheers
Family circles let families you choose see each other's children's first names, animals and weekly stars, and let children send a fixed set of spoken sticker cheers. Only share an invite code with people you know and trust, and don't use a family name that could offend or identify anyone other than your family. You can leave a circle at any time, and we may remove a circle or member that misuses the feature.
7. Your licence to use Kululu
Kululu, including its characters Kululu and Juno, stories, artwork, voices, music, sounds and software, belongs to us or our licensors and is protected by intellectual property law. We give you a personal, non-exclusive, non-transferable licence to use Kululu for your family's own non-commercial use, on devices you own or control, for as long as these terms apply.
You may not copy, sell, rent, publicly perform or share Kululu's content, record or redistribute its stories or voices, or copy, modify or reverse-engineer the app, except where the law allows it.
8. Fair use
Please don't:
- use Kululu to harm, harass or contact anyone other than as the app intends;
- add names or family names that are offensive or belong to someone you're not allowed to add;
- try to get around Premium, the grown-up check, limits on name recordings, or our security; or
- use bots, scraping or automated tools on Kululu or our systems.
9. Changes to Kululu and to these terms
We keep improving Kululu, so activities, stories and features may change. If a change significantly reduces what Premium includes during a period you've paid for, contact us and we'll make it right, which may include a refund for the unused part where the law requires it.
We may update these terms. If a change is important, we'll tell you in the app or by email before it takes effect. If you don't agree, you can stop using Kululu and cancel your subscription.
10. Our responsibility to you
We provide Kululu with reasonable care and skill, and we'll fix problems we're responsible for. Kululu depends on your device, internet connection and services such as the App Store, so we can't promise it will always be available or free of errors.
To the extent the law allows, we're not responsible for losses that weren't reasonably foreseeable, that were caused by something outside our reasonable control, or that relate to business use, and our total responsibility to you for any claim is limited to the amount you paid us for Kululu Premium in the 12 months before the claim. Nothing in these terms limits responsibility that can't be limited by law, such as for gross negligence, fraud or rights under the Consumer Protection Act.
11. Ending the agreement
You can stop using Kululu and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, after warning you where it's reasonable to do so. If we close your account without good reason, we'll refund any unused, prepaid part of your subscription. If we ever stop offering Kululu, we'll give you reasonable notice.
12. Apple
If you downloaded Kululu from the App Store, Apple's Licensed Application End User License Agreement also applies. These terms are between you and us, not Apple. Apple isn't responsible for Kululu or its content, has no obligation to provide maintenance or support for it, and isn't responsible for any claims relating to it, including product liability, legal or regulatory claims, or intellectual property claims. If Kululu fails to meet an applicable warranty, you may notify Apple, which may refund the purchase price as its policies allow. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties.
13. Law and disputes
These terms are governed by the laws of the Republic of South Africa. If you have a complaint, please contact us first so we can try to sort it out. If we can't, you may refer it to the Consumer Goods and Services Ombud, the National Consumer Commission, or a court with jurisdiction. If you live outside South Africa, you keep any protection the consumer laws of your country give you and may bring proceedings in your local courts.
If any part of these terms is found to be unenforceable, the rest still applies.
